In this article, the author adresses the concept and definition of proportionality in procedural law in light of civil and common law traditions. The relative importance of proportionally in both culture is emphasized. The auhot a;so adresses the Canadian applications of proportionality in Quebec law with article 42 C.C.P, as well as in Ontario and British Colombia law, along with perspectives for future reform. She concludes that he concept of proportionality must evolve in conjonction with a corresponding change in outlook, a broad interpretation of this principle and important adjustments to the rules of ethics governing the legal profession.
